Test and Tracing Programme: Allocation of Reserve Funding to Justice and Home Affairs and Chief Operating Office in 2020

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

The allocation of up to £22.8 million in 2020 from the General Reserve to JHA (Justice and Home Affairs) and COO (Chief Operating Office) as detailed in the attached report, to fund the Test & Tracing Programme (T&TP).

 

Decision(s):

The Minister:

  • approved the allocation of an additional £22.8 million in 2020 from the General Reserve with indicative allocation of up to £21.5 million and up to £1.27 million allocated to JHA and COO respectively to fund the Test and Trace Programme;
  • approved the balance of MD-TR-2020-0053 of £1.5 m to be allocated to JHA in place of HCS (Health & Community Services); and
  • instructed the Treasurer of the States to approve drawdowns as requested by JHA and COO for the T&T Programme Phase II of amounts up to the total amounts within this decision.

Reason(s) for Decision:

Article 15(3) of the Public Finances (Jersey) Law 2019 states that the approval by the States of a government plan authorises the Minister to direct how an approved appropriation for a reserve head of expenditure in the plan may be spent (including on another head of expenditure) in the first financial year covered by the plan.

 

The current Policy for Allocations from the Reserve agreed by the Minister for Treasury and Resources (published as R.80/2020) sets the requirement that all proposed allocations from the General Reserve (Covid-19), once recommended for approval by the Treasurer of the States (taking into account comments from the Principal Accountable Officer), are referred for review to either the Council of Ministers or the relevant Competent Authorities Ministers prior to submission to the Minister for approval.

 

Seven separate business cases for the cost of the Test & Tracing Programme PhII to the end of 2020 have been submitted and reviewed and two have previously been funded. On the basis of the approvals of the business cases the Treasurer recommends this allocation to the Minister for approval subject to the following recommendations:  

 

  1. T&E representation at the Programme Board;
  2. Given considerable costs, a review of Fees and Charges;
  3. Dedicated Financial and Analytical Support to be appointed;
  4. A full review after Quarter 3;
  5. Contingency withheld and draw down based upon agreement on scope and costs;
  6. Policy decisions to be informed by financial implications;
  7. Ring-fence and withhold contingency for hotel isolation measures; and
  8. Modernisation & Digital to lead on all technology developments.

 

The Council of Ministers have agreed this allocation in principle at their meeting on 26th August 2020.

 

The Minister has previously approved allocations to the Test & Tracing Programme. Business Cases have now been received for the complete T&TP PhII to the end of 2020. The remaining balance of MD-TR-2020-0053 of £1.5 is still required in 2020 and this decision will instead approve the allocation of the balance to JHA instead of HCS (Health & Community Services).

Individual drawdowns against the £22.8 million will be made by documented Treasurer decisions following confirmation of requirements from the relevant departments and approval of any required procurement exemptions by the Group Director, Commercial Services where necessary.

 

Resource Implications:

The General Reserve head of expenditure to decrease by up to £22.8 million and the JHA and COO heads of expenditure to increase by indicative amounts of up to £21.5 million and up to £1.27 million respectively in 2020.

 

Action required:

The Head of Financial Governance to advise the Specialist – Business Cases and the Head of Finance Business Partnering of JHA and COO that this decision is approved.
