Road Traffic (St Peter) (Amendment No.7) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST PETER) (JERSEY) ORDER 1992

 

 

Purpose of the Report

 

To amend the Road Traffic (St Peter) (Jersey) Order 1992 introducing new prohibition of waiting restrictions.

 

 

Background

 

Amendment to Schedule 2 “Prohibition of Waiting” of the Road Traffic (St Peter) (Jersey) Order 1992

 

On 06 September 2013 the Minister for Transport and Technical Services approved a request from the Parish of St Peter to amend the Parish Road Traffic Order to prohibit waiting in three locations across the Parish in order to improve road safety in those areas.  The roads are La Rue Bechervaise, La Rue de L’Eglise and Le Mont du Jubilé.

Amendments to Schedule 2 “Prohibition of Waiting” summarised below

 

La Rue Bechervaise

 

Both sides of the road from the entrance to St Mathieu car park to a point 10 metres to the west of the junction with La Route du Couvent.  This road borders the parishes of St Lawrence and St Mary and as such both Connétables were consulted and confirmed that there are no objections to this restriction.

 

La Rue de L’Eglise

 

From the junction with La Petite Rue de la Pointe to a point 83 metres in a north easterly direction.

 

La Mont Du Jubilé

 

From the junction with La Route du Moulin for a length of 240 metres in an easterly direction.

 

 

Recommendation

 

The Minister is recommended to approve the attached amendment to the Road Traffic (St Peter) (Jersey) Order 1992, to come into force 14 days after it is made.

As requested by the Parish of St Peter, to impose waiting restrictions on La Rue Bechervaise, La Rue de L’Eglise and La Mont du Jubilé.
