Advance to Work and Advance Plus Schemes: Transfer from Treasury and Resources Department to Social Security Department

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Transfer of the Advance to Work and Advance Plus schemes from the Department of Education Sport and Culture to the Social Security Department

Decision(s):

The Minister decided to accept responsibility for the permanent transfer of the Advance to Work and Advance Plus schemes with effect from 1 September 2012 subject to approval for the additional headcount from the Treasury Department.

 

With effect from 1 January 2013, funding of £950,000 for the period 1 January 2013 to 31 December 2013 will be transferred from the Department of Education, Sport and Culture to the Social Security Department. No uplift is included for 2014 and 2015.

 

There is a current full-time equivalent (FTE) of 18 that will be transferred from the Department of Education, Sport and Culture to the Social Security Department from 1 September 2012. A request has been made to the Treasury for formal approval of the remaining 7 FTE currently employed as detailed in the table below:

There are proposals in place to extend the schemes for the period 2013 to 2015. This will be funded from Social Security growth bids.

Reason(s) for Decision:

This decision was made to ensure that all projects that fall under the remit of the Back to Work project team are administered by one department to ensure consistency of approach and service delivery across all schemes.

 

 

Resource Implications:

There are no budgetary implications for 2012, as funding for this period will be provided from the Social Security Back to Work project.

 

The Medium Term Financial Plan will reflect the move as a service transfer of £950,000 from the Department of Education, Sport and Culture to the Social Security Department in 2013 as detailed above. 

 

Following approval of the request from the Treasurer for FTE against the additional 7 posts and the transfer of 18 FTE from the Department of Education, Sport and Culture, the Social Security Department will have an additional 25 FTE.

Action required:

Treasurer to approve additional FTE. Social Security Finance and Operations Director to implement transfer.
