Budget transfer: Central Contingency funding for Brighter Futures 2014 deficit

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and reason for the decision

The Chief Minister requested the Treasury Minister, in accordance with a decision taken by Council of Ministers on 30 October 2013, to agree to make a non-recurring budget transfer of £13,886 from  Central Contingency in 2015 to the Chief Minister’s Department Revenue head of Expenditure.

The Council of Ministers in its meeting on 30 October 2013 agreed to provide funding from the Central Contingency Fund to Brighter Futures to support its continued operation in 2014 and 2015. (Report no 1446/1(95)).

The Brighter Futures annual accounts (signed by their Board in December 2015) show a funding shortfall on £13,886 for 2014. The Chief Minister requests the £13,886 budget transfer from Central Contingency in 2015 in order that a payment of the same amount can be made to Brighter Futures to cover that 2014 shortfall.

The Chief Minister notes that:

  • £13,886 is significantly less than the anticipated shortfall;
  • in accordance with the COM decision, additional contingency monies may also be transferred in order to support any 2015 Brighter Futures shortfall;
  • the decision taken by the Council of Ministers was an exceptional decision made in light of the charity’s reported funding difficulties, which the charity is committed to resolve through the appointment of a dedicated Executive Officer.

Resource implications

The Chief Minister’s Department’s revenue head of expenditure would increase by £13,886 in 2016 and the Central Contingency would decrease by the identical amount.
