Jersey Architecture Commission: Commissioner: Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment:

  1. endorsed the appointment of Melanie Dodd, architect, academic and Programme Director of Spatial Practice at Central St Martins College of Art and Design in London, as a commissioner on the Jersey Architecture Commission; and
  2. endorsed a three year term of office to run from August 2013. 

Reason(s) for Decision:

  1. The role of the JAC has become increasingly important following the resignation of the Department Architect in 2011 and the loss of the post;
  2. Following the retirement of George Ferguson CBE from the Jersey Architecture Commission (JAC) in 2012 the JAC has been operating with only 8 members as opposed to the 9 originally appointed;
  3. The replacement of George Ferguson with someone able to bring a similarly wide and off-Island perspective is seen as an important key element in the work of the JAC. Following advertisement of the post the department received a number of applications for the post.
  4. The post was advertised in the JEP and a total of ten applications were received. It was important to retain the Jersey /UK balance within the group and the preference was to appoint from outside the Island if a suitable candidate could be found.
  5. Ms Dodd was interviewed by Andrew Scate (CEO , Department of the Environment ) , Marcus Binney  (Chairman JAC) and Richard Williamson (Executive Office to the JAC). There was unanimous agreement that Melanie Dodd was an excellent candidate and would bring valuable experience and skills to the JAC.

Legal and Resource Implications:

  1. The costs associated with running the JAC are met from within existing DoE budgets.
  2. There are no legal implications: the JAC operate in an entirely advisory capacity

Action required:

  1. Formally invite Ms Dodd to join the JAC as a commissioner on the basis of a three year term, commencing August 2013.
