Delegated Authority Decisions.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister noted the decisions taken by officers under delegated powers in the period 3/11/06 To 30/11/06.

Flat 2, Hazelgrove, 73 Rouge Bouillon, St Helier - Lease Renewal for a period of two years from Mrs Joan Annie Perree née Swift. Existing rental is £10,400 per annum and the new rental is £10,800 per annum.

Former Corporate Stores Warehouse, La Collette, St Helier - Renewal of Licence between the Public and Paul Davis Freight Services Limited for a further 12 months at an annual licence fee of £75,689.28.

Amendment to Property Contracts between the Public and Jersey Telecom - Five Oaks Mast site, St Saviour and Communications Centre and Mast Site, St Ouen to allow the provision of independent electricity supplies.

La Crête Quarry Shed, St Martin - Lease Assignment from Mr Justin Surcouf of Ormer & Scallops of Jersey Limited effective from 1 January 2007 with a passing rent of £4,000 per annum to Miss Sue Smith and Mr Frank Mahood.

Miltonia, St John’s Road, St Helier - Lease Renewal for a period of two years from Mrs Judith Brenda Mary Smith née Cummins. Existing rental is £17,968.32 per annum and the new rental is £18,615.18 per annum.

Maison St Louis Observatory Flat, Highlands Lane, St Saviour - Lease Renewal for a period of one year from Mr Michael Hugh Le Brocq. Existing rental is £8,640 per annum and the new rental is £8,951.04 per annum.

186 Le Clos des Sables, St Brelade - Sale of Unexpired Portion of 99 Year lease of 186 Clos des Sables by Miss Heidi Frances Norman to Mr Andrew Charles Cummings and agree to the modification of the lease.

Reason(s) for decision:

To note the officer decisions in respect of the above lease and licence renewals, amendment and lease assignment and sale of unexpired portion of lease made under delegated powers in accordance with the Minister’s Decision of the 20 February 2006.

Action required:

The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
