Employment Forum Membership: Appointment and Extension

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Employment Forum Membership – Appointment of new member and extension of term of office

Decision(s): The Minister decided to appoint Dr Gary Jones to the Employment Forum for a three year term, starting on 1 May 2014. The Minister also decided to extend the term of office of Mrs Jeralie Pallot, an existing member of the Forum, for a three year term from 1 June 2014.

Reason(s) for Decision: The Employment Law requires that members of the Employment Forum must be appointed by the Minister for Social Security.

 

Following a period of open recruitment and selection undertaken by the Forum during January to March 2014, the Chairman and the members of the Forum recommended the selected candidate – Dr Gary Jones - for appointment as an independent member. The Forum also recommended that the term of office of Mrs Jeralie Pallot should be extended for three years.

 

Both individuals are recommended as possessing a great deal of knowledge and experience that will enable them to make a valuable contribution to the work of the Forum in continuing with the minimum wage review and consultation on other employment law matters, as directed by the Minister.

Resource Implications: There are no financial or manpower implications.

Action required: Policy Principal to advise Dr Jones that the Minister has approved his appointment and to advise Mrs Pallot that that the Minister has approved an extension to her term of office. The Employment Law does not require that the States is notified of appointments to the Forum.
