Liquor Licensing (Jersey) Law 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Draft Liquor Licensing (Jersey) Law 201-: lodging.

Decision(s):

The Assistant Minister with responsibility for liquor licensing policy approved the draft Liquor Licensing (Jersey) Law 201- and the accompanying report. He further agreed that the draft Law should be lodged ‘au Greffe’ on 5th June 2017, with a view to securing a States debate on 18th July 2017 or as soon as possible thereafter.

Reason(s) for Decision:

The draft Law has been endorsed by both the Shadow Alcohol and Licensing Policy Group and subsequently by the Council of Ministers.

 

Connétable S.W. Pallett of St. Brelade retains delegated authority for liquor licensing policy and development of the new Law, in accordance with the terms of R.12/2015.

Resource Implications:

Resource implications are set out in full in the report accompanying the proposition.  The new Law will in due course require £100,000 per annum ongoing funding (inclusive of funding for up to 1 FTE) plus up to £100,000 one-off set-up costs from the restructuring provision to support implementation of a new online administration system. Efforts will be made to reuse systems already being procured or in development in other departments, so as to minimise the funding required from the restructuring provision.

 

The intention is for the above costs to be borne by industry through the setting of a revised fee structure, the nature of which will be set out in draft Regulations. 

Action required:

Report and proposition to be forwarded directly to the States Greffe. The Greffier of the States is requested to arrange for the proposition to be lodged ‘au Greffe’ on the date specified above.
