Air and Sea Ports (Suspension of Licence Requirements) (Jersey) Order 2015

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  The making of an Order exempting the Ports of Jersey Limited from the requirement to hold a licence to conduct port operations for two months.

Decision(s):  The Minister made the Air and Sea Ports (Suspension of Licence Requirements) (Jersey) Order 2015.

Reason(s) for Decision:  Following the approval of the Air and Sea Ports (Incorporation) (Jersey) Law 2015 and the Air and Sea Ports Incorporation (Transfer) (Jersey) Regulations 2015, the Ports of Jersey Limited (PoJL) will incorporate on 1st October 2015, and become responsible for the operation of the harbours and airport. This legislation requires that any organisation conducting ‘port operations’ (i.e. operating a harbour or airport) requires a licence to do so.

 

The Channel Island Competition and Regulatory Authority (CICRA) will grant a licence to the PoJL following the necessary legal process, which includes a period of consultation. As this process could not begin before incorporation, there will be a period in which the PoJL will be required to operate the ports but the licence has not been granted.

 

To cover this period, the Law provides that the Minister may by Order grant an exemption to the need to hold a licence. The effect of this Order would be to exempt the PoJL from the need to hold a licence for two months. It is unlikely that this full period will be required as it is expected that the licence will be awarded on 1st November 2015. The two month period is intended to allow for any unforeseen delay.

Resource Implications: There are no resource implications.  

Action required: The Greffier of the States is requested to make the arrangements for the Air and Sea Ports (Suspension of Licence Requirements) (Jersey) Order 2015 to the laid before States.
