Licensing (No. 18) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Her Majesty the Queen’s official 90th birthday: related extension to permitted hours for first category licensed premises on 10th and 11th June 2016.

Decision(s):

The Assistant Minister, acting in accordance with his delegated authority as per Ministerial Decision MD-E-2015-0012 and having agreed that Regulations should be lodged to extend the permitted hours of First Category (Taverners) licensed premises from 11.00pm in the evening to 1.00am of the next morning on the nights of 10th and 11th June 2016 –

(a) ratified law drafting instructions previously supplied to the Law Draftsman,

(b) approved the draft Licensing (No.18) (Jersey) Regulations 201- and an accompanying report, and

(c) instructed the Policy Manager to arrange for the draft Regulations to be lodged ‘au Greffe’ no later than 12th April 2016 and with a view to securing a debate on 24th May 2016.

Reason(s) for Decision:

To celebrate the occasion of Her Majesty the Queen’s official 90th birthday, in keeping with a decision taken by the UK Home Secretary under section 172 of the UK Licensing Act 2003 to mark an occasion of 'exceptional international, national or local significance.’

Resource Implications:

There may be resource implications for the States of Jersey Police Force, which may in any event deploy additional resources on 10th and 11th June as a consequence of the televising of European Championship football matches. These may be mitigated by reduced evening movement between premises of persons having consumed alcohol and a corresponding reduction in drink-related arrests, as reportedly experienced by the Police during the previous comparable extension in 2011.

 

An ancillary cost will be generated by the publication of an official notice of the change via the Jersey Gazette.  Although this cost will be borne by the Judicial Greffe, it may seek to recharge the Economic Development, Tourism, Sport and Culture Department for the placing of the notice.

 

Action required:

Policy Manager to forward to the States Greffe the approved draft Regulations and accompanying report by 11th April, request 24th May as the date for debate and notify the Judicial Greffe of the anticipated requirement for a related public notice.
