Sale of land at Balleine Close, St. Clement.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. agreed to rescind MD-H-2008-0002
  2. agreed to the proposal to sell the land to Mr & Mrs Moore for the sum of £500.00, subject to the meeting the Public’s reasonable legal and other costs
  3. agreed to request that the Treasury & Resources Minister agree to the transaction under Standing Order 168(2)(a) and that following notification to the States in accordance with Standing Order 168(3) to authorise the Greffier and Attorney General to sign the necessary contracts on behalf of the Public.

Sale of land at Balleine Close, St. Clement.

REPORT TO THE HOUSING MINISTER  

PROPOSED SALE OF LAND AT BALLEINE CLOSE, ST CLEMENT

The Minister will recall that on 28th January 2009 he agreed to sell a small piece of land at Balleine Close, St Clement to the Parish of St Clement in order that the Parish could sell its property ‘The Halt’.  It had been identified during title checks that the boundary wall of ‘The Halt’ cuts across land owned by the Public and consequently there is a small parcel of Public owned land on the Parish side of the boundary wall.   

It was proposed that a contract be passed in the Royal Court to sell that small parcel of land to the Parish to allow the establishment of new lines of demarcation between ‘The Halt’ and Balleine Close.  It was proposed that the Parish of St Clement would pay the sum of £500.00 in respect of the transaction and would meet the Public’s associated legal fees.  

That transaction was never completed and the Parish of St Clement subsequently sold ‘The Halt’ to Mr & Mrs Ken Moore. 

Mr & Mrs Moore subsequently approached the Public with a request to complete the proposed transaction in their joint names as the new owners of ‘The Halt’.  The proposed terms are the same as those set out in MD-H-2008-0002 save for the following additions:- 

  1. That Mr & Mrs Moore will be required to contribute a 1/6th share of the costs of maintaining, renewing and replacing that part of the estate road which is adjacent to ‘The Halt’.

 

  1. That Mr & Mrs Moore will pay an additional consideration of £500 for officer time (£250 Housing & £250 Property Holdings) for the work associated with preparing the contracts.

 

  1. That Mr & Mrs Moore will pay the Public’s reasonable legal expenses associated with the transaction.

 

Recommendations 

That the Minister; 

  1. agree to rescind MD-H-2008-0002

 

  1. agree to the proposal to sell the land to Mr & Mrs Moore for the sum of £500.00, subject to the meeting the Public’s reasonable legal and other costs

 

  1. agree to request that the Treasury & Resources Minister agree to the transaction under Standing Order 168(2)(a) and that following notification to the States in accordance with Standing Order 168(3) to authorise the Greffier and Attorney General to sign the necessary contracts on behalf of the Public.
