Public Health and Safety (Rented Dwellings) (Jersey) Law 2018 (Appointed Day) Act 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Appointed Day Act - Public Health and Safety (Rented Dwellings) (Jersey) Law 2018

Decision:

The Minister approved and decided to lodge ‘au Greffe’ the Draft Public Health and Safety (Rented Dwellings) (Jersey) Law 2018 (Appointed Day) Act 201-

Reason(s) for Decision:

The Public Health and Safety (Rented Dwellings)(Jersey) Law 2018 was adopted by the States on 13 December 2017, sanctioned by Order of Her Majesty in Council on 14 March 2018 and registered by the Royal Court on 23 March 2018.

 

The Law introduces minimum health and safety standards with respect to rented dwellings, and provides an enforcement mechanism where such dwellings fail to reach the required standards.

 

Article 22 of the Law provides that the Law shall come into force on such day as the States may by Act appoint.

 

This Appointed Day Act will bring into force the Public Health and Safety (Rented Dwellings) (Jersey) Law 2018, on 1 October 2018.

Resource Implications:

There are no financial or manpower implications. The following statement of financial and manpower implications was included in the Proposition for the Draft Public Health and Safety (Rented Dwellings) (Jersey) Law 201- (P.66/2017), lodged 17 July 2017.

“The draft Law will be implemented without any increase to the current Department of the Environment financial budgets and without any change to the current Department of the Environment manpower levels. The draft Law provides that the States may make Regulations to establish a scheme of licensing rented dwellings, and in particular to enable the Minister to issue and charge for licenses.”

 

There may be resource implications associated to the Regulations, which will be lodged for States approval at a future date.

The Greffier of the States to arrange to lodge the Draft Appointed Day Act ‘au Greffe’, to be listed for the States sitting of 11 September 2018.
