Les Quennevais School (New): Approval of Drawings and Acceptance of Stage 2 Tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Article 33(b) and QE

Article 34(b)

Subject:

Les Quennevais School - Approval of Drawings and Acceptance of Stage 2 Tender

Decision(s):

(a)  In accordance with Standing Order 168 (1) (d), the Minister, approved the drawings and specifications associated with the approved Planning and Building Control Permits describing the proposed Main Contract Works, as recommended by Jersey Property Holdings.

(b)  The Minister agreed to accept the negotiated stage 2 tender price formed by ROK-Regal Limited in conjunction with Tillyard Quantity Surveyors in the sum of £38,235,835.96 for the Main School Building and Sports Hall; and enter into a formal JCT 2011 Contract.

Reason(s) for Decision:

The key drawings noted above and which Planning approval has been granted (Permits P/2017/1015) reflect the use for which the funding is provided.

Under Standing Order 168 (1) (d), it is a requirement for the Minister of the Department of Infrastructure to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

The approved Procurement Strategy adopted a two-stage tender approach.  This second stage follows the approval a Pre-Construction Services Agreement to develop an affordable cost with ROK-Regal Ltd that fits within the allocated budget.

The negotiations with ROK-Regal Ltd have concluded and produced a cost of £38,235,835.96 for the remaining works which can be accepted and a contract entered into.

Resource Implications:

  1. The contract sum can be accommodated within the allocated capital budget relating to Les Quennevais School (FXA071). The financial implications of this decision are set out in the accompanying report and its appendices.

  1. There are no manpower implications in respect of this decision.

Action required:

Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.
