Sex Discrimination Consultation: Summary of Responses (R.137/2014)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Report to the States - Sex Discrimination consultation outcomes

Decision(s): The Minister decided to present to the States a written Report which summarises the outcomes of the consultation on legislation to protect against sex discrimination.

Reason(s) for Decision: The Minister had issued a white paper in March 2014 inviting representations from stakeholders on the proposed scope of protection against discrimination on grounds of sex. The Minister had committed to conducting further consultation with stakeholders before introducing any further protected characteristics. The Minister invited comments on a number of policy issues including sex discrimination in pay systems and what other characteristics should be protected at the same time as sex, such as pregnancy, sexual orientation, gender reassignment and marriage and civil partnership. The Minister also asked what exceptions should apply so that an act would not be treated an act of sex discrimination, e.g. relating to religion, charities and associations.

 

The Minister is very grateful to those who responded during the consultation. The Minister’s report provides an overview of the responses received, including quotes to give an indication of the range of responses to each question. The consultation responses will inform the Minister’s decisions in regard to the law drafting that will shortly be requested. The Sex Discrimination consultation outcomes document will be circulated to those who responded to the consultation (for whom contact details were provided) and those on the States’ public consultation Register. The document will also be available on the States’ website.

Resource Implications: There are no financial or manpower implications.

Action required: Policy Principal to request the Greffier of the States to arrange for the Report to be presented to the States on 18 September 2014. Policy Principal to arrange for the necessary public circulation of the documents on the same date.
