2023 Financial Year: Repurposing of Funds to various Heads of Expenditure

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Treasury and Resources decided to approve for the 2023 financial year:  • the repurposing of up to £2,852,195 of 2023 growth, • repurposing of up to £2,408,500 of unspent in-year allocations from the reserve; and   the allocation from Reserves of up to the following amounts in respect of 2023:  • £66,000 to the Bailiff’s Chamber heads of expenditure, • £7,600,000 to the Health and Community Services head of expenditure, • £82,000 to the Law Officers’ Department head of expenditure, • £21,000 to the Orchard House project head of expenditure; and • £1,000 to the Sewage Treatment Works project head of expenditure.

Reason for Decision(s):

Article 15(3) of the Public Finances (Jersey) Law 2019 states that the approval by the States of a Government Plan authorises the Minister to direct how an approved appropriation for a reserve head of expenditure in the plan may be spent (including on another head of expenditure) in the first financial year covered by the plan.  The current Procedures for Allocations from the Reserve, presented to the States Assembly as R.76/2022, sets out the requirements for allocations from the General Reserve and the Reserve for Central Risk and Inflation Funding. These requirements have been met and the Treasurer of the States now recommends these allocations to the Minister for Treasury and Resources for approval.

Resource Implications: The following Heads of Expenditure will decrease: - the General Reserve by up to £7,666,000. - the Reserve for Centrally Held Items: Court and Cases Costs Smoothing Reserve by up to £82,000. - the Reserve for Central Risk and Inflation Funding by up to £22,000.  The following Heads of Expenditure will increase: - Bailiff’s Chambers by up to £66,000. - Health and Community Services by up to £7,600,000. - Law Officers’ Department by up to £82,000. - Orchard House by up to £21,000. - Sewage Treatment Works by up to £1,000  This decision does not change the total amount of expenditure approved by the States in the Government Plan 2023-26.

 

Action Required: The Minister’s Private Secretary to advise the Specialist Special Project Assurance – Strategic Finance and the Heads of Finance Business Partnering for the associated Heads of Expenditure that this decision is approved.
