Budget transfers within Department for Infrastructure

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

The transfer of £1.4 million from the Department for Infrastructure (DfI) Revenue Head of Expenditure to the DfI Infrastructure Capital Head of Expenditure (Q00RL10011) to replenish the budget in the capital head of expenditure to pre-agreed levels. The £1.4 million was carried forward from 2016 revenue underspends as part of the 2016 carryforward process.

 

A separate transfer of £237,900 from the DfI Revenue Head of Expenditure to be split with £69,900 to the DfI Infrastructure Capital Head of Expenditure (Q00RL10011), and £168,000 to the Road Safety Improvements Capital Head of Expenditure (Q00MF15037) in relation to the St Peter’s Valley Path Scheme. The £237,900 was approved to be carried forward from 2016 revenue underspends for use on DfI capital schemes related to infrastructure.

Decision(s):

The Minister approved:

  • the transfer of £1.4 million from the Department for Infrastructure (DfI) Revenue Head of Expenditure to the DfI Infrastructure Capital Head of Expenditure (Q00RL10011); and
  • the transfer of £237,900 from the DfI Revenue Head of Expenditure to be split with £69,900 to the DfI Infrastructure Capital Head of Expenditure (Q00RL10011), and £168,000 to the Road Safety Improvements Capital Head of Expenditure (Q00MF15037) in relation to the St Peter’s Valley Path Scheme.

Reason(s) for Decision: 

Article (18)(c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be transferred from one head of expenditure to another head of expenditure for any purpose.

 

A decision (MD-T-2017-0069) was signed by the Minister for Infrastructure on 4th September 2017.

 

Resource Implications:

The DfI Revenue Head of Expenditure to decrease by £1,637,900; the DfI Infrastructure Capital Head of Expenditure to increase by £1,469,900 and the Road Safety Improvements Capital Head of Expenditure to increase by £168,000.

Action required:

The Head of Decision Support to notify the Finance Manager, Department for Infrastructure that the decision has been approved.

  1. Purpose of Report

To consider the request from the Department for Infrastructure for:

 the transfer of £1.4 million from the Department for Infrastructure (DfI) Revenue Head of Expenditure to the DfI Infrastructure Capital Head of Expenditure (Q00RL10011); and

 the transfer of £237,900 from the DfI Revenue Head of Expenditure to be split with £69,900 to the DfI Infrastructure Capital Head of Expenditure (Q00RL10011), and £168,000 to the Road Safety Improvements Capital Head of Expenditure (Q00MF15037) in relation to the St Peter’s Valley Path Scheme.

 

2.     Background

 

 Due to existing funding pressures within the Department for Infrastructure, and the wider States of Jersey, the Infrastructure Capital Head of Expenditure has been operating on a reduced budget allocation for a number of years. In 2016 the Department was underspent within its Revenue Head of Expenditure and requested to carry some of this underspend forward and transfer it to the Infrastructure Capital Head of Expenditure.

 

The 2016 carryforwards of £1.4 million and £237,900 were approved and the amounts were transferred into the DfI Revenue Head of Expenditure. This decision transfers these budgets to the correct Capital Heads of Expenditure.         

 

3.     Recommendation

The Minister is recommended to approve:

  • the transfer of £1.4 million from the Department for Infrastructure (DfI) Revenue Head of Expenditure to the DfI Infrastructure Capital Head of Expenditure (Q00RL10011); and
  • the transfer of £237,900 from the DfI Revenue Head of Expenditure to be split with £69,900 to the DfI Infrastructure Capital Head of Expenditure (Q00RL10011), and £168,000 to the Road Safety Improvements Capital Head of Expenditure (Q00MF15037) in relation to the St Peter’s Valley Path Scheme.
