Jersey Voluntary and Community Sector Limited: Interim Grant Payment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and reason for the decision

The Chief Minister has determined that the Chief Officer for Community and Constitutional Affairs (CCA) should provide Jersey Voluntary and Community Sector Limited (JVCS) a one-off interim payment of £5,833 in order that the charity can continue to operate during April 2016, prior to it securing funding from an independent charitable trust. This independent funding is due to commence in May 2016.

The JVCS received a grant from Chief Ministers Department which ended in December 2015, as per the signed partnership agreement.  The grant was provided for initial pump priming and so is not being continued beyond the period agreed.

The JCVS has sufficient funds to operate until end March 2016, and is securing ongoing funding which will begin in May 2016.  It therefore requires one month interim funding during April 2016.  The Chief Minister has therefore determined to provide a one-off grant of £5,388 to enable the charity to continue to operate during operation during April. £5,833 represents 1/12 of the annual grant of £70,000 previously provided to the JVCS by the Chief Minister’s Department.

Responsibility for supporting the Chief Minister in relation to the voluntary and community sector moved from the Chief Minister’s Department to the Department for Community and Constitutional Affairs (CCA) in January 2016.  No budget was transferred to CCA alongside the transfer of responsibility.

Resource implications

The Department for Community and Constitutional Affairs’ expenditure will increase by £5,833 in 2016.
