Reciprocal Social Security Agreement with Ireland.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

· The Minister approved the draft Report and Proposition regarding a Social Security (Reciprocal Agreement with Ireland) (Jersey) Act 200- and requested that it be lodged as soon as possible, for debate by the States on 11 September 2007.

Reason(s) for decision:

· On 9 September 1997, the States approved in principle the inclusion of the Jersey Social Security Scheme within a proposed consolidation of the existing reciprocal social security agreements between the United Kingdom and Ireland.

· On 23 June 2005, the Employment and Social Security Committee directed that an Act should be drafted, for approval by the States, to formally agree the text of the Agreement before it should come into force in respect of Jersey.

· An Exchange of Notes and Instruments of Ratification has taken place on 3 July 2007, which included some amendments to the Convention.

· Article 37 of the Convention states that it will come into force on the first day of the third month following the month in which the Instruments of Ratification are exchanged. The Agreement is therefore due to enter into force on 1 October 2007.

· The text of the Agreement should be agreed by the States of Jersey before the Agreement comes into force in respect of Jersey.

· The Chief Minister has responsibilities for matters of international relations affecting Jersey, and is the appropriate person to lodge the attached Act.

Action required:

· Notify the Greffe of the decision and to forward to the Greffier the attached draft Report and proposition and the draft Social Security (Reciprocal Agreement with Ireland) (Jersey) Act 200-

· Inform the Minister for Social Security, who has agreed to act as rapporteur in the States.

· Greffe to lodge the draft Social Security (Reciprocal Agreement with Ireland) (Jersey) Act 200- as soon as possible, for debate by the States on 11 September 2007.
