Employment (Amendment No. 10) (Jersey) Law 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Lodge the Draft Employment (Amendment No.10) (Jersey) Law 201-  

Decision(s): The Minister decided to lodge ‘au Greffe’ the Draft Employment (Amendment No.10) (Jersey) Law 201-.

Reason(s) for Decision: The Minister for Social Security proposes an amendment to the Employment (Jersey) Law 2003 that would introduce a number of miscellaneous changes to the Employment Law (MD-S-2015-0109). The draft amendment includes the following changes;

 

  1. Employment protection for armed forces reservists, including a right to return to work after a period of reserve service and additional protection against unfair dismissal. (MD-S-2015-0011)
  2. Compensation awards for employees where an employer fails to comply with the law in relation to written terms of employment, pay slips and rest days (MD-S-2015-103).
  3. An enabling power to allow (but not require) a higher minimum wage rate for older employees.
  4. A minor technical change relating to statutory and contractual redundancy pay.
  5. Provision for the fair dismissal of staff covering for those on maternity, parental or adoption leave.
  6. Aligning the unfair dismissal qualifying period for short fixed-term contracts (MD-S-2015-104).

 

Certain of the provisions would come into force immediately and others have been assigned an appointed day of either 1 September 2016 or 1 April 2017 to give employers time to adjust their practices and procedures, where necessary.

Resource Implications: There are no financial or manpower implications.

Action required: Policy Principal to request the Greffier of the States to arrange to lodge the Draft legislation ‘au Greffe’ on 12 April 2016, to be listed for the States sitting of 24 May 2016. Policy Principal to provide copies of a draft consolidated version of the Employment Law to the Bookshop by 10 May and request that the Greffier of the States arranges for that document to be circulated to States Members for reference, not as part of the Proposition itself.
