A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The Navigator Restaurant, Le Havre de Rozel, Trinity

Modification of Planning Permission P/2005/1939 to vary the approved plans to change the line of the fencing around an area of decking approved as a minor amendment to the original approval.

Decision(s):

The Minister made a commitment to use his statutory powers to amend the above Planning Permit in order to address concerns in regard to the amenity deck and fencing on the roof of the restaurant.

Reason(s) for Decision:

So as to safeguard the amenity of nearby residents.

Resource Implications:

If this case was to be tested in the Royal Court the modification could be deemed unreasonable and costs might be awarded.

ARTICLE 27

 

NOTICE OF REVOCATION OR MODIFICATION OF PLANNING PERMISSION

 

 

1.         THIS IS A FORMAL REVOCATION /OR MODIFICATION NOTICE issued by the Minister for Planning and Environment ("the Minister") pursuant to the powers conferred on him under Article 27 of the Planning and Building (Jersey) Law 2002;

 

2.         THE MINISTER, having considered all the issues before him in relation to the Planning Permit, P/2005/1939 as amended by the letter of 17 May 2006 has concluded that the development shall only be carried out in accordance with the modification to the approved plans specified in section 3 of this Notice in order to safeguard the amenity of nearby residents.

 

3          THE MINISTER HEREBY GIVES YOU NOTICE THAT THE WORKS AT THE LAND AFFECTED BY VIRTUE OF PLANNING PERMIT P/2005/1939 SHALL BE MODIFIED AS INDICATED;

The fencing around the decking area on the roof of the building shall only be erected as demonstrated on the plan attached to this Notice

5.                     WHAT WILL HAPPEN IF THIS NOTICE IS NOT COMPLIED WITH:  A person failing to carry out the aforementioned development in accordance with the requirements of this Notice, in pursuance with the aforesaid Law, shall be guilty of an offence and liable to a fine; and papers will be dispatched to the Law Officers’ Department for the purpose of prosecution.

 

7.         In accordance with Article 27 compensation may be payable in relation to this Notice
