Comprehensive Spending Review: Budget transfer from Treasury and Resources for Restructuring Provision

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Requests for Restructuring Provision funds in support of the Comprehensive Spending Review - transfer of budget from Treasury and Resources  to Health and Social Services

Decision(s):

The Minister requested that the Minister for Treasury and Resources approve the following:

(a)            a maximum transfer of £615,000 in 2012 and a commitment of £82,000 in 2013 in support of the CSR process to be funded from the Restructuring Provision; and

(b)            that this is enacted through a 2012 budget transfer of £615,000 from the Restructuring Provision to the Health and Social Services Department under Article 15(1)(a) of the Public Finances (Jersey) Law 2005;

 

 

Reason(s) for Decision:  

 

This request for funding over the next 2 years is for two projects in Health and Social Services and is supported by the Council of Ministers.  The funding will enable the CSR projects to be progressed in a timely manner to deliver recurring savings in line with the overall CSR programme.

 

Article 15(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

Resource Implications:  

The Treasury and Resources revenue head of expenditure to decrease by £615,000 and £82,000 in 2012 and 2013 respectively and the Health and Social Services revenue head of expenditure to increase by the same amount.
