Planning and Building (Miscellaneous Provisions) (Jersey) Order 2015

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. To rescind MD-PE-2015-0018 Planning and Building (Miscellaneous Provisions) (Jersey) Order 2015 signed on 16 March 2015 as the copy of the Order attached to the decision was not properly endorsed

 

  1. In accordance with Articles 8, 11, 13, 76, 80 and 120 of the Planning and Building (Jersey) Law 2002 the Minister made the Planning and Building (Miscellaneous Provisions) (Jersey) Order 2015 to amend;

 

  • Planning and Building (General Development) (Jersey) Order 2011
  • Planning and Building (Application Publication) (Jersey) Order 2006
  • Planning and Building (Environmental Impact) (Jersey) Order 2006
  • Planning and Building (Display of Advertisements) (Jersey) Order 2006
  • Planning and Building (Moveable Structures) (Jersey) Order 2006
  • Planning and Building (Fees) (Jersey) Order 2008

 

as indicated in the attached and endorsed Order

The Amendments to come into force the day after the date of this decision.

 

Reason(s) for Decision:

 

  1. The copy of the Order attached to MD-2015-0018 was not properly endorsed and as such was not properly made

 

  1. The amendments to the Orders reflect the Planning and Building (Amendment No.6) (Jersey) Law 2014 and the Planning and Building (Amendment of Law) (Jersey) Regulations 2015 which establish a new process for appeals against decisions and actions under the Law. In particular the Amendment removes the Minister from the first tier of decision making so as to appropriately consider appeals.

Resource Implications:

Functions in the Orders are already carried out by the Department and as such there are no resource implications for the amendments.

Action required:

The Greffier of the States be requested to arrange for the Order to be presented the States at the earliest opportunity
