Rosewood House / Clinique Pinel - refurbishment - approval of drawings and tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Exempt 3.2 (a) (x).

Subject: Rosewood House/Clinique Pinel Upgrades

Decision(s): 

1. The Minister approved, as recommended by Jersey Property Holdings, the drawings numbered 10282/1, 2, 3, 4, 5, 6, 7 and 8 showing the alteration to Rosewood House, and 

2. The Minister approved the lowest tender submitted by Larsen Limited in the sum of £1,490,063 in a period of 44 weeks.  

Reason(s) for Decision: 

Under Standing Order 168 (1) (d) the Assistant Minister, under delegated authority, is required to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States. 

The estimated total cost for the works (including the lowest tender received, professional fees and ‘other’ costs), as designed, can be completed within the allocated Fiscal Stimulus budget approved by the Minister for Treasury and Resources (MD-TR-2010-0111 refers). 

The works have been approved by the Minister for Health and Social Services (MD-HSS-2010-0037 refers). 

The lowest fix price tender submitted by Larsen Limited in the sum £1,490,063 can be accepted and a contract entered in to.

Resource Implications:

There are no financial or manpower implications in respect of this decision other than those detailed above.

Action required: 

1.  Approved funds to be transferred from the Fiscal Stimulus fund to Jersey Property Holdings and H&SS Department as set out in the report. 

2. Contract to be signed with Larsen Limited.
