Maritime Temporary Exclusion Zone: Electricity Cable Laying Operations: 23 July 2016 until completion

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Temporary Exclusion Zone for cable laying operations

 

Decision(s):

The Minister issued a Direction under Regulation 1(2)(a) of the Harbours (Jersey) Regulations 1962 to establish a temporary exclusion zone in Jersey territorial waters in the immediate vicinity of the cable laying operation. All vessels are prohibited to pass within 1000 metres ahead or to the side of the cable layer STEMAT SPIRIT and its support vessels LYDIA D, NOVA K and VDC LYNX or 500 metres astern of these vessels without clearance from STEMAT SPIRIT.

This is to come into force on 0001 UTC on 23 July 2016 until cable laying operations have been completed.

Reason(s) for Decision:

Cable laying operations for a new France to Jersey electricity cable are scheduled to start on 23 July and last for five weeks. The vessel concerned will be restricted in its ability to manoeuvre and there is a risk to navigation in its vicinity. It should be noted that these operations will take place in an area in which there is already a permanent prohibition in place for anchoring, fishing, trawling or laying of pots and this remains in force under the Harbours (Protection of Cables in Territorial Waters) (Jersey) Regulations 2010. Therefore no new prohibition on fishing is required.

Resource Implications:

There are no new financial, property, ICT or human resources issues arising for the States of Jersey.

Action required:

The Harbour Master is requested to promulgate the appropriate Notice to Mariners and carry out any necessary supervision and enforcement.
