A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

1. The development hereby approved shall be carried out entirely in accordance with the plans and documents permitted under this permit. No variations shall be made without the prior written approval of the Minister for Planning and Environment or an authorised officer of the Development Control section of Planning and Building Services.

2. For the avoidance of doubt the detailing of the new dormer windows and conservation rooflights shall match those previously approved as part of the original application.

3. The application hereby approved is for the stated revisions to the previously approved development (P/2007/0810) only. All of the original conditions still apply.

Conclusion

This is a Revised Plans application for a loft conversion to the recently approved redevelopment of the Maison du Coin site.

The only external changes to the approved scheme will be 2 dormer windows and a small conservation rooflight all of which are forward facing on the site and therefore do not overlook any neighbouring properties - the overall size and scale of the approved building does not change. The detailing of the dormers and the rooflight will match that previously approved and are considered appropriate to a development of this nature.

The site lies within the Built Up Area and the affected unit provides sufficient parking to allow the additional habitable space.

Site Description

Maison du Coin is located on the periphery of a cluster of dwellings to the north-east edge of St John’s Village; it forms the last site within the Built-Up Area when heading away from the village along La Route du Mont Mado. To the east is open fields and the site, as a consequence, is generally quite visible from the public realm. The other houses within the vicinity are generally of mid-late twentieth century construction.

 

 

Relevant Planning History

This is a Revised Plans application for a loft conversion to unit 1 of the newly approved Maison du Coin redevelopment. The original scheme (P/2007/0810) was for the demolition of the existing house and its replacement with a pair of new houses in a traditional Jersey ‘farmhouse’ and wing. This application was approved in May 2007.

The only external change to the approved scheme will be the introduction of 2 dormer windows (of a style and size to match others approved as part of the scheme) and 1 conservation rooflight. These elements will all face to the south across the site towards the main road.

As approved, the house is a 4 bedroom unit. With the additional habitable space in the loft, this would potentially become a 6 bedroom unit.

Design & Use of Materials

The new dormers will match the existing approved dormers and are appropriate in design for a development of this nature (lead cambered roofs, timber windows).
