1 - 4 Fauxbie Villas, St. Saviour's Road, St. Helier: Notice of Intention not to List

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment resolved to serve a notice of his intent not to List the buildings specified above.

Reason(s) for decision:

The interest of the buildings specified above, as defined and in the schedule and relative to the published criteria for selection, does not justify their inclusion on the List of Sites of Special Interest as a Listed Building or Place in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002, in particular because, whilst this group of mid-1930s houses retain many external architectural features, their design is modest and somewhat conservative for this period when other Modern movement and Art Deco inspired houses were being built in the Island, and they cannot therefore be regarded as significant or special relative to the development of Jersey houses at this time.

Legal and resource implications:

  1. Article 51 of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place.
  2. Article 52 of the same Law requires the Minister to serve Notice of his intention to do so.
  3. There are no additional resource implications of this decision.

Action required:

Serve Notice of Intent Not to add the buildings specified above to the List.
