International Sanctions - New Law: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  New international sanctions Law – drafting instructions

Decision(s):

The Minister for External Relations decided that the Law Draftsman be instructed to draft a new international sanctions Law.  

Reason(s) for Decision:

 

A new international sanctions Law is required to enable Jersey to implement UK sanctions Regulations made pursuant to the Sanctions and Anti-Money Laundering Act 2018, which is due to come into force once the UK leaves the EU.

 

The new international sanctions Law should seek to achieve the following –

  • to preserve a version of the power to implement EU sanctions that is currently in the European Union Legislation (Implementation) (Jersey) Law 2014, but will be repealed once the European Union (Repeal and Amendment) (Jersey) 2018 is brought into force;
  • to add a similar power to implement UK sanctions, when those are made under Part 1 of the Sanctions and Anti-Money Laundering Act 2018 (when it is brought into force following Brexit);
  • to bring together the asset-freezing regimes (including provision for licensing) currently in the Terrorist Asset-Freezing (Jersey) Law 2011 and the United Nations Financial Sanctions (Jersey) Law 2017 (and possibly others), and to enable the resulting united asset-freezing regime to be applied also to asset-freezes imposed under implemented UK and EU sanctions (as described above);
  • to include appropriate provisions as to enforcement, including obtaining and sharing information, and as to reviews and appeals;
  • to make, if practical in the timescale available, any other appropriate improvements to Jersey legislation and implementation of international sanctions regimes.

There are no manpower or resource requirements arising from this Decision.

The Head of International Compliance to send law drafting instructions to the Law Draftsman requesting a new international sanctions Law be prepared.
