Oncology Department: Approval of drawings and tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Refurbishment of Jersey General Hospital Le Quesne Unit to form new Oncology Department  - Approval of Drawings and Acceptance of Tender to Refurbish Existing Facilities.

(DA 0011-01-002)

Decision(s):

(a)   In accordance with paragraph 1 (d) of Standing Order 168, the Assistant Minister, under delegated authority, approved drawings numbered/ref:(10432/03,04,09,10,11,12 & 22A) - all showing the proposed works to refurbish the Le Quesne Unit at the General Hospital.

 

(b)   The Assistant Minister agreed to accept the lowest fixed price tender submitted by ROK Construction Ltd in the sum of £657,411.18 to refurbish the Le Quesne Unit at the General Hospital and enter into a formal JCT Building Contract.

Reason(s) for Decision:  

The drawings noted in item (a) above and which planning & bye-law approval has been granted (Planning Application No. P/2013/0955 & Building Permit B/2013/0619/ refers) reflect the use for which the funding is provided.

 

Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

 

The estimated total cost for the refurbishment of the Le Quesne Unit at the General Hospital (including the lowest tender received, professional fees and ‘other’ costs), as designed, can be completed within the allocated budget.

 

The lowest fixed price tender submitted by ROK Construction Ltd in the sum of £657,411.18 can be accepted and a contract entered into.

 

Resource Implications:

Other than those detailed in the report there are no further financial or manpower implications.

 

Action required:

The Assistant Minister to sign the contract and any other associated documentation in accordance with the approved scheme of delegation.
