Education (Discretionary Grants- Amounts) (Amendment) (No. 7) (Jersey) Order 2015

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Education, Sport and Culture made an Order, entitled the Education (Discretionary Grants – Amounts) (Amendment) (No. 7) (Jersey) Order 2015.

 

The effect of this Order is to cap the amount of course fees considered for a grant at £9,000, from the academic year starting in September 2015. The cap does not apply to course fees for clinical years of medical and related courses. However, at an institution where the course fees for non-clinical years of such a course are above £9,000 (and so are subject to this cap), the Minister may also limit the amount taken into account (above £9,000) for the clinical years of that course, if the result would otherwise be disproportionate in relation to any other course.

 

The Order will come into effect on 1st September 2015.

 

Reason(s) for Decision:

It is necessary to place a cap on the amount of course fees in order that the Department may continue to provide financial support to students in higher education whilst at the same time operating within the existing budget for higher education. It is recognized that the cost of medical and related courses is much higher than other courses of higher education, and additional financial support will continue to be provided in these cases where appropriate.

 

Resource Implications:

There are no additional resource implications, as the changes can be met from the existing budget.

Assistant Director, Policy and Strategy, to notify the Publications Editor at the States Greffe that the Order has been made and to request the Greffier of the States to arrange for the making of the Order to be notified to the States
