Skateboard Park: Acceptance of funds from Treasury and Resources for interim security

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Acceptance of £6,380 from Treasury and Resources to fund interim security for the skateboard park

Decision(s): The Minister decided to accept £6,380 from Treasury and Resources to fund interim security for the skateboard park between 5th October and 9th November 2011.

 

Reason(s) for Decision: The Education, Sport and Culture Department is responsible for the Skateboard Park and has undertaken to make improvements for the purposes of health and safety. The Park required interim security until the improvements were made, which Treasury and Resources have agreed to fund.

 

Due to the location of the Skateboard park, Jersey Harbours have organised the security. Therefore, the Treasury and Resources Department has agreed to transfer the necessary funding to the Economic Development Department to cover the costs that Jersey Harbours have incurred for the security arrangements.

 

Article 15(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. Delegation 1.3 (October 2010) delegates authority for non-contentious transfers between expenditure heads of up to £1,000,000 to the Treasurer of the States

 

Resource Implications: EDD will receive £6,380 from Treasury and Resources for the purpose of paying for the security of the Skateboard park. 

 

Action required: Treasury and Resources will transfer £6,380 to EDD, which will be used by EDD to cover the costs incurred by Jersey Harbours for the security at the Skateboard park.
