Records Advisory Panel: Appointment of Chair and Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Appointment of Members of the Records Advisory Panel.

Decision: The Assistant Minister for Economic Development, Tourism, Sport and Culture (with responsibility for Culture, Arts and Heritage) has re-appointed two members of the Records Advisory Panel for a three-year term: Anne Harris and Marie-Louise Backhurst.

 

Following an open appointments process, involving advertising of the forthcoming vacancies and formal interviews, the Minister also approved the appointment of three new members to serve on the Records Advisory Panel for a four-year term: Catherine Kirby, Matthew Swan and Clive Jones.

 

The Minister has also appointed Mrs. Anne Harris as Chair, upon the recommendation of the interviewing panel. The process was overseen by the Jersey Appointments Commission. The Minister decided to present a Report to the States Assembly to inform them of these appointments.

Reasons for Decision: Under Article 14 of the Public Records (Jersey) Law 2002, the Minister for Economic Development, Tourism, Sport and Culture is responsible for the appointment of five people to serve on the Records Advisory Panel and for advising the States of those appointments. The Minister is also responsible under Article 14 of the Law for appointing a Chair from the members of the Panel. The terms of office of the current panel expire on 15th January 2022 and the Minister is required to appoint a new panel to succeed it.

Resource Implications: There are no resource implications. 

Action required: The Minister directed that the successful applicants should be informed of their appointment, arrangements made for their swearing-in before the Royal Court as soon as practical. The Greffier of the States to be asked to arrange for the attached Report to be presented to the States Assembly as soon as possible.
