Appointment of States Directors to the Waterfront Enterprise Board

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Waterfront Enterprise Board (WEB): Appointment of States Directors

Decision(s):  The Chief Minister approved the report and proposition entitled, ‘Waterfront Enterprise Board: appointment of States Directors’ which, if adopted, would cause Connétable D.J. Murphy of Grouville, Connétable J.M. Refault of St. Peter and Deputy E.J. Noel of St. Lawrence to be appointed as States Directors of the Waterfront Enterprise Board.

Reason(s) for Decision:  The current States’ Directors of WEB are Senator P.F. Routier and Mrs J.J. Huet (former Deputy), who were appointed on 28th March 2006 for a 3-year period expiring on 31st March 2009.

 

Unfortunately it has not proved possible to finalise the proposals for a new property development company sufficiently early to allow the appointment of a new Board to coincide with the end of period of office of the existing States Directors. Therefore in the meantime, and pending a States decision on the formation of a new property development company, it is necessary to appoint States Directors to WEB on an interim basis to ensure the continued operation of the Board. In accordance with WEB’s Memorandum and Articles of Association, these appointments must be made for a period of 3 years. However it is anticipated that these appointments will run for a considerably shorter period. As soon as the States has decided upon the form and structure of the successor to WEB the new Board will be appointed by means of a transparent process overseen by the Appointments Commission.

 

At the meeting of the Council of Ministers held on 5th March 2009 the Council endorsed the Chief Minister’s proposal to lodge a report and proposition nominating Connétable Murphy, Connétable Refault and Deputy Noel as States Directors.

 

Resource Implications:  There are no financial or manpower implications

Action required:  Policy and Research Manager to arrange for the lodging au Greffe of the attached Report and Proposition by 10th March 2009 with a view to securing a debate in the States Assembly on 31st  March 2009.
