States of Jersey Police: Chief Officer: Re-Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Re-appointment of the Chief Officer, States of Jersey Police.

Decision(s):

The Minister decided to propose the re-appointment of Mr Michael Bowron as Chief Officer of the States of Jersey Police for a further period of 4 years with effect from 4 January 2017 and approved a Report and Proposition recommending the re-appointment.

Reason(s) for Decision:

Mr Bowron’s current contract expires on 4 January 2017.  He has indicated that he would like to remain in post for a further period of 4 years from that date, to January 2021 and this is supported by the Minister.  His re-appointment would ensure continuity and resilience within the States of Jersey Police senior ranks.

 

Article 9 of the States of Jersey Police Force Law 2012 provides that the States may make Regulations prescribing the way in which a person may be appointed to the office of the Chief Officer and that the Regulations may prescribe who may make the appointments and determine the periods of the appointments and the way in which they may be extended.  However, these Regulations are not yet in force so, in accordance with Article 2 of the States of Jersey Police Force (Transitional Provisions) (Jersey) Order 2014, Articles 9(1), (2), (4) and (5) of the Police Force (Jersey) Law 1974 are treated as if they remain in force until such time as the Regulations under Article 9 of the 2012 Law are in force.  Article 9(1) of the 1974 Law provides that the Chief Officer of the States of Jersey Police shall be appointed by the States.

Resource Implications:

There are no additional manpower or financial implications arising from this decision.


Action required:

The Executive Officer, Home Affairs to request the Greffier of the States to arrange for the attached Proposition to be lodged ‘au Greffe’ for consideration by the States on 8 September 2015.
