Chief Minister's Department: Budget Carry Forwards

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: To request approval in principle from the Treasury and Resources Minister for the carry forward of unspent 2011 revenue budgets in the Chief Minister’s Department to fund the 2012 cost pressures described in this report.

Decision(s): The Chief Minister agreed to request that the Treasury and Resources Minister approves in principle the carry forward of the Chief Minister’s Department unspent 2011 revenue budget up to a limit of £277,000 with effect 1st January 2012, as described in the accompanying report.

Reason(s) for Decision: Under Article 15(1) of the Public Finances (Jersey) Law 2005 the Minister for Treasury and Resources can permit all or any part of the amount appropriated by a head of expenditure to:

  1. be used for the purposes of another head of expenditure; or
  2. In the case of revenue expenditure, be withdrawn from the Consolidated Fund after the end of the relevant financial year.

Financial Direction 3.6 section 5.1 states that departments wishing to transfer funds between heads of expenditure must obtain the approval of their minister.

Resource Implications: The amount of the carry forward for these purposes will be limited to £277,000 and will not exceed the under-spend achieved by CMD in 2011. Funding for 2013 and future years will be considered as part of the first Medium Term Financial Plan.

Action required:  Project and Research Officer to inform the Finance Director – Corporate Group of the Chief Minister’s decision. Minister for Treasury and Resources to agree ministerial decision approving the carry forward.
