Jersey Bank Depositors Compensation Board: Appointments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister has decided to approve the re-appointment of Amy Taylor and Ian Henderson as members of the Jersey Bank Depositors Compensation Board (the “Board”). The Minister has also decided to approve the appointment of Katherine Hitchins as a member of the Board.

Reason for Decision(s):

The Board was established in 2015 under the Banking Business (Depositors Compensation) (Jersey) Regulations 2009 to administer the Jersey Bank Depositors Compensation Scheme.    Regulation 10(2) provides that members of the Board shall be appointed by the Minister after consulting with the Appointments Commission. Regulation 10 (2A) stipulates that the States of Jersey (Appointment Procedures) (Jersey) Law 2018 shall apply to such appointments. Accordingly, the Minister gives two weeks’ notice to the States Assembly of their intention to make these appointments.  The appointments of Ms Taylor and Mr Henderson are due to conclude in September 2025 and October 2025 respectively.  In recognition that there is anticipated to be a maximum of six months post conclusion of their current terms, it is recommended that both are reappointed until the 31st March 2026, at which point the Board is expected to be dissolved.  Mr. Peter Shirreffs' appointment is set to conclude in March 2025 after nine years in the role. According to the Jersey Appointments Commission (“JAC”) guidance, “States appointees and members of independent bodies should not normally be appointed for terms in excess of nine years”. To ensure the Board has the capacity to fulfil its functions during the short period leading up to its planned dissolution in March 2026, a new appointment is required to replace Mr. Shirreffs. It is recommended that the Minister appoint Ms. Hitchins, currently an independent member of the Jersey Resolution Authority (“JRA”), to the Board. This approach will help mitigate risks to the continuity of the Board’s functions as they transition to the JRA at the end of 2025.

Resource Implications: There are no new financial and/or staffing implications.

 

Action Required: Officers to request the Greffier of the States to arrange for the item to be presented to the States Assembly.
