Delegated Authority Decisions - Property Holdings

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister noted the decisions taken by officers under delegated powers in the period 25 July to 8 August 2007.

1) F7 Quennevais Park, St Brelade - Sale of Unexpired Portion of 99 year lease from Mrs Maureen Elsie Richardson née White to Mr Adam Kristian Kennard and Mrs Emma Jane Kennard née Aubert.

2) Assignment of lease in relation to Unit Nos 19-22 situated in the Fish Market, St Helier from Mr Julian Verdesca to Mr Gabriel Ferreira de Rosa for the remaining term of the 9 year lease which commenced on 20 April 2005. The assignment is deemed to be effective from 1 August 2007. The passing rental is £8,800 per annum.

3) 57 Great Union Road and Cottage B, 53½ Great Union Road - Consent for access rights to Andrew Carl Willis and Janet Willis née Bates for the purpose of maintaining the roof structure, gutter and capping atop the south party boundary wall. The granting of the right to Mr and Mrs Willis to render over the Public’s side of the south party boundary wall at their sole cost.

Reason(s) for decision:

To note the officer decisions in respect of the sale of an unexpired lease, assignment of lease and consent for access rights as detailed above made under delegated powers in accordance with the Minister’s Decision of the 22 December 2005.

Action required:

The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
