A & E / Radiology (Phase 2) approval of budget transfers and approval of best value tender.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   

A&E / Radiology (Phase 2) approval of budget transfers and approval of best value tender.

Decision(s): 

Following approval of drawings 4520/L02 made in Ministerial Decision MD-HSS-2008-0036, the Minister agreed -  

(a) to seek the approval of the Minister of Treasury and Resources for a budget transfer of up to £310,326 from underspends in the Day Surgery Budget (JZ0038) to the A&E/Radiology (phase 2) project (JZ0063); 

(b) to seek the approval of the Minister of Treasury and Resources to transfer the sum of £277,000  from the Crematorium Gardens project (J20023) and £511,000 from the Tube System Upgrade project (J20079) to the A&E/Radiology (phase 2) project (J20063); 

(c) to seek the approval of the Minister of Treasury and Resources for inflation funding to be transferred from the Fluctuation Reserve to cover increased building costs since December 2006 to November 2010 in the following categories - 

A&E / Radiology -  £259,000

Tube System -  £  61,000

Crematorium Gardens - £ 53,000

TOTAL -    £373,000; and 

(d) accepted the best value tender submitted by Camerons Limited in the sum of a contract period of 101 weeks, subject to approval of the Minister of Treasury and Resources.

Reason(s) for Decision: 

To provide sufficient budget to allow the H&SS’s Minister to accept the best value tender received from Cameron Limited to extend the Accident & Emergency Department at the General Hospital; which requires relocating part of the existing Radiology Department:

Resource Implications: 

Other than those detailed in the report there are no further financial or manpower Implications.

Action required: 

Treasury to action capital budget transfers, subject to the approval of the Minister for Treasury and Resources. 

Officers of Property Holdings, in conjunction with the H&SS Department, to oversee contract signing and to monitor post contract activities in accordance with FD 5.6.
