Road Traffic (Speed Limits) (Jersey) Order 2003 - Amendment.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Road Traffic (Speed Limits) (Amendment No.2) (Jersey) Order 2007, to become effective 14 days after it is made, the purpose of which is

ROAD TRAFFIC (SPEED LIMITS) (JERSEY) ORDER 2003

Purpose of the Report

To amend the Road Traffic (Speed Limits) (Jersey) Order 2003

Background

The Minister for Transport and Technical Services has supported requests from the Parishes of St John, St Helier, and St Peter for an amendment to the above Order, with regard to:-

  1. St John

 

Extending the 30mph speed limit on La Grande Route de St John, and La Route de Nord

  1. St Helier

 

Reducing the speed limit on La Rue de Mon Sejour, from 30mph to 20mph

  1. St Peter

 

Extending the southern leg of the 20mph speed limit on La Route de Beaumont

Discussion

1. St John

The Connétable of St John has requested that the 30mph speed limit on La Route de Nord be extended to 120 yards beyond La Rue de L’Etocquet, to increase the safety of the elderly residents of Maison Le Marquand when accessing La Route de Nord, from their entrance.

The Connétable has also requested that the 30mph speed limit on La Grande Route de St Jean be extended to 9 yards north of La Rue de Bechet, to facilitate the installation of the new village entry sign.

2. St Helier

The Connétable of St Helier has requested that the speed limit on La Rue de Mon Sejour be reduced from 30mph to 20mph to allow for further traffic calming on this primarily residential parish road.

3. St Peter

The Connétable of St Peter has requested that the 20mph speed limit on La Route de Beaumont be extended south, to just beyond La Rue St Clement to allow this small road, together with La Rue du Presbytere, La Rue des Fosse and La Petite Rue des Fosses to be included in the current 20mph speed limit.

This request is considered necessary due to the nature and narrowness of these small parish roads situated in the vicinity of the Parish Hall.

Recommendation

The Minister approved the attached Amendment No.2, and make it effective from two weeks after the Order is made.

At the request of the Connétables, to amend the Road Traffic (Speed Limits) (Jersey) Order 2003.

The Minister to instruct his officers to process the Ministerial decision.
