Budget transfer from Education Department to Department for Infrastructure to fund capital works at Victoria College School

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Budget transfer from Education Department to Department for Infrastructure to fund capital works at Victoria College School.

Decision(s): The Minister for Education approved a budget transfer of £567,950 in 2016 from the Education capital head of expenditure (E00MC10003 Minor Capital) to the Department for Infrastructure capital head of expenditure (FA0MD09002 Victoria College Extension). The Minister for Education also approved an internal Education budget transfer of £162,950 from VC Francis Field capital head of expenditure (E00DD12122) to minor capital head of expenditure (E00MC10003).

Reason(s) for Decision: The Ministerial Decision (MD-ESC-2016-0014) signed on 18 April 2016 and the Governors’ letter to parents dated 27 April 2016, covering Victoria College fees for the academic year 2016-2017, highlighted the need for fee increases to assist with funding for capital projects as set out in the Victoria College 10 Year School Development Plan. Accumulated revenue to capital transfers in recent years now provide Victoria College with sufficient funding to replace the porta cabins on College Field with a much needed new classroom block. Part of the funding for the capital project will be taken from the VC Francis Field capital head of expenditure set up for the development of Francis Field as a sports facility for Victoria College and Victoria College Prep. This project is presently on hold and Victoria College’s share of the unspent budget (£162.950) is unlikely to be required for some years. The budget will be replenished from future school fee increases.

 

Article 18(1)(c) of the Public Finances (Jersey) 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. Delegation 1.2 delegates authority for non-contentious transfers between heads of expenditure of up to £1,000,000 to the Treasurer of the States.

Resource Implications: The Education Department capital head of expenditure to decrease by £567,950 in 2016 and the Department for Infrastructure capital head of expenditure to increase by an identical amount. This decision does not change the total amount of expenditure approved by the States for 2016.

Action required: The Minister for Education to seek approval of the Treasurer of the States for the transfer.
