Jersey Architecture Commission: Membership

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   The Jersey Architecture Commission: membership

Decision(s):  The Minister for Planning and Environment;

  1.  Re appointed to the JAC , for which the Minister is solely responsible , Antony Gibb, Andy Theobald, Stuart Fell, Sara Marsh and David Cox. Their term of office to expire on the 1st  August ,2016.
  2. Determined to extend the term of office of Marcus Binney, David Watkin and Mike Waddington to expire on the 1st August 2016. Noted that the remaining Commissioner, Melanie Dodd has a term of office which will also expire on the 1st August 2016
  3. Noted the work of the JAC in relation to the advice it offered regarding all aspects of design both as part of the assessment of planning applications and design briefs.
  4. Endorsed the wish of the JAC to allow the rotation of the chair and to allow Andy Theobald to take over that role with a term of office until the 1st August 2016. Noted that Marcus Binney has chaired the JAC since it’s establishment in 2010.

 

Reason(s) for Decision:

The Minister is required to take into account all material considerations in determining planning applications and the design and architecture of major development schemes is such a consideration, as set out in the policy requirements of the 2011 Island Plan.

To continue to maintain and enhance standards of design and architecture in jersey it is considered appropriate and desirable to secure informed, independent critical design advice through the forum of the JAC.

The Minister had noted that all five had previously served spells on the JAC since its inception. The Minister noted that he had agreed and endorsed the continuation of the JAC (MD-PE-2012-0010) and endorsed the reappointment of four members in January 2012 and a further 3 others in April 2013.  The Minister noted the increasing use made of the JAC by the Department and by applicants and agents. The Minister wished to harmonise the term of office of the Commissioners to a single date.

Resource Implications:

There are no legal implications of the decisions set out above. There are no resource implications of the decisions as the Department has made provision for the operation of the JAC within its budgets and its management and administration can be met from existing resources.

Action required:

Re appoint the Commissioners for a further two years with effect from the 1st April 2014.
