Misuse of Drugs (Jersey) Law 1978 – Classification of Substances Commonly Known as ‘Legal Highs’ as Controlled Drugs

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision:

The Minister, having previously endorsed the recommendations of the Misuse of Drugs Advisory Council, made the Orders to classify a range of substances commonly referred to as “Legal Highs” as controlled drugs under the Misuse of Drugs (Jersey) Law 1978

  1. Background

 

The Misuse of Drugs Advisory Council (MDAC) is established in accordance with Article 2 of the Misuse of Drugs (Jersey) Law 1978 and has a duty to advise the Minister on measures, which in its opinion, should be taken to prevent the misuse of drugs and/or to deal with the social problems connected with drug abuse.

The MDAC has previously recommended to the Minister that a range of substances, commonly referred to as Legal Highs, be brought under the control of the Misuse of Drugs (Jersey) Law 1978. These substances can broadly be classified into 3 groups; Benzylpiperazine (BZP) and related compounds; Synthetic cannabinoids; and substances which mimic the effect of ecstasy.  

The Minister endorsed the recommendations of the Misuse of Drugs Advisory Council on the 21st September 2009 (MD-HSS-2009-0049) and accordingly determined that an amendment to the Misuse of Drugs (Jersey) Law 1978, as amended, should be prepared. 

The Misuse of Drugs (Amendment of Schedule 2 to Law) (Jersey) Order 2009 and the Misuse of Drugs (General Provisions) (Amendment) (Jersey) Order 2009 make the necessary amendments to the Misuse of Drugs (Jersey) Law 1978.

The Minister is recommended to make the following Orders which will come into effect seven days after they are made 

  • Misuse of Drugs (Amendment of Schedule 2 to Law) (Jersey) Order 2009
  • Misuse of Drugs (General Provisions) (Amendment) (Jersey) Order 2009
