Road Traffic (Third-Party Insurance) (Expenses Limits) (Jersey) Order: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Road Traffic Third party Insurance Expenses Limits- Annual increases

Decision(s):  The Minister approved the annual charge increase as described in the report Annual Increase in the Tariff and Ceiling on Charges laid out in the Motor Traffic (Third-Party Insurance) (Expenses Limits) (Jersey) Order 2014.

Reason(s) for decision: For this scheme to be administered effectively, it is imperative that the charges levied in Jersey are identical to those collected by the UK’s Compensation Recovery Unit. This means that charges will be increased annually from 1 April.

 

Resource Implications: The Compensation Recovery Unit charge Jersey £8 per claim. As the scheme is yet to become fully established, income is yet to be determined.

Action required: The law draftsman is requested to amend the Motor Traffic (Third-Party Insurance) (Expenses Limits) (Jersey) Order 2013 to reflect the uplifted charges as described in the report.

Annual Increase in the Tariff and Ceiling on Charges laid out in the Motor Traffic (Third-Party Insurance) (Expenses Limits) (Jersey) Order 2014.

In February 2013 the Minister for Health and Social Services, in pursuance of Article 3 of the Motor Traffic (Third-Party Insurance) (Jersey) Law 1948, made the Motor Traffic (Third-Party Insurance) (Expenses Limits) (Jersey) Order 2013.

This Order set out the tariffs and ceiling on charges for costs so that maximum amounts may be recovered from third-party insurers in respect of the costs of treatment and ambulance services for the treatment of victims of road traffic accidents.

The Compensation Recovery Unit, on behalf of the Department of Health currently administers this scheme in the UK where it is called The NHS Injury Cost Recovery (ICR) Scheme. Since February 2013 they have also administered it for Health and Social Services in Jersey.

 

It was previously agreed that the tariffs in Jersey would be the same as those in the UK and must be uplifted annually to reflect increases in costs, as per the UK. The annual uplift in the UK occurs on 1 April each year.

 

The tariff and ceiling on charges (cap) payable by compensators for the recovery of treatment and ambulance costs will increase from 1 April 2014.  The increases will apply only to injuries sustained on or after this date.

 

The charges in Jersey should be revised, in line with those in the UK, as follows:

These revised tariffs have been communicated to the Minister for Transport and Technical Services as is required by law. The Minister for Transport and Technical Services is requested to approve these new tariffs by Ministerial Decision.

 

The Minister for Health and Social Services is requested to approve instruction to the law draftsman to prepare an Order under Article 3 of the Motor Traffic (Third-Party Insurance) (Jersey) Law 1948 to reflect the revised charges as of 1 April 2014.
