Jersey Harbours Trading Fund: Approval to use for Jersey Harbours GBJ Project

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Qualified Exempt: Freedom of Information (Jersey) Law 2011, Article 35

Subject:  Approval for use of Jersey Harbours Trading Fund for Jersey Harbours Terminal GBJ project.

Decision(s): The Minister approved additional expenditure of up to £500,000 for the Jersey Harbours Terminal GBJ project from the Jersey Harbours Trading Fund.

Reason(s) for Decision:  Regulation 22 (2)(b) of the Public Finances (Transitional Provisions) (No 2) (Jersey) Regulations 2005 provides that: Money standing to the credit of the trading fund of a States trading operation may also be used, with the approval of the Minister, for a capital project of the trading operation if the project arises from a contingency that could not have been reasonably foreseen at the time the estimates of the States trading operation were submitted to the Minister in accordance with Article 8 of the 2005 Law for inclusion as part of an annual business plan.

 

The Elizabeth Terminal bar, café and restaurant is to be refurbished. The concept is a partnership with Ports of Jersey investing capital to refurbish the new facility to enable the unit to be leased out.

Resource Implications: The available balance of the Jersey Harbours Trading Fund will be reduced by £500,000 and the Jersey Harbours Terminal GBJ project capital head of expenditure will be increased by £500,000.

Action required:  

Head of Decision Support to notify Financial Performance Reporting Manager and Group Financial Controller, Ports of Jersey, that this decision has been approved.

 

A new capital head of expenditure for the Jersey Harbours Terminal GBJ project to be set up.
