Fiscal Stimulus Plan: Allocation of funds for work at Overdale Hospital

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Economic Stimulus Plan: budget allocation to Jersey Property Holdings for the delivery of works at McKinstry Ward (Overdale Hospital Site).

Decision(s):  The Minister approved the allocation of £235,020 for the McKinstry Ward project, which is the enabling phase of the project to refurbish Rosewood House, to the Property Holdings department, of which £221,195 is to be transferred to its budget as soon as possible. The remaining £13,825 will be retained at programme level as a contingency against which the Property Holdings department can request drawdown if required. The allocation of £221,195 now will enable the contract to be let to the contractor which submitted the preferred tender.   

The Minister further instructed the Construction and Maintenance project group to report on spend of all stimulus monies, and project progress/performance, on a monthly basis in accordance with guidelines set by the Treasury, and return any unspent monies on completion of the project.

Reason(s) for Decision: 

A discretionary fiscal stimulus allocation from the Stabilisation Fund of £44m has already been approved. The projects meet the key criteria for fiscal stimulus being timely, targeted and temporary and will benefit local business and individuals. The £235,020 allocation to the project will enable the Construction and Maintenance project group to progress the Rosewood House refurbishment scheme by providing alternative accommodation for the residents in readiness for the date at which Rosewood House needs to be vacated.

Resource Implications:   No financial resource implications other than those explained above and in the accompanying report.

No manpower resource implications. 

Action required:   Treasury to be informed of decision to release necessary funds to the Jersey Property Holdings’ budget.
