Approval of tenders for La Carriere, Clos Des Quennevais and 1-21 Le Geyt Flats.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Approval of Tenders for refurbishment projects at La Carriere, Clos Des Quennevais, Le Geyt Flats 1-21.

Decision(s): The Minister:-

 

1.                   Accepted A.C. Mauger & Son Ltd as the preferred contractor for the refurbishment of all 3 estates, based on their combined tender submission of £1,913,420 on the basis that it represents the lowest compliant tender.

2.                   Instructed that a copy of this decision be forwarded to the Treasury & Resources Minister for his information, in line with paragraph 5.16.25 of Financial Direction 5.6.

3.                   Authorised the virement of £180,782 from HYR 000 to HYC026.

4.                   Authorised the Director of Estate Services to sign the necessary contracts on his behalf.

 

Reason(s) for Decision: To Comply with Financial Direction 5.6, para 5.16.24

 

Resource Implications: Commitment of £2,310,663 from the Departments Capital Budget and the transfer of £180,782 from the rolling vote HYR000 to HYC026.

 

Action required: Director of Estate Services to arrange placing of contracts, to arrange for the virement of the necessary funds to the appropriate account, and by copy of this MD inform the Treasury & Resources Minister of the outcome of the tendering process in line with paragraph 5.16.25 of Financial Direction 5.6.
