Mont Fallu: Visibility Improvements

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Resource Implications: The cost of the scheme is to be funded as part of the Department’s Sustainable Transport and Road Safety Schemes programme along with Planning Obligation Agreement contributions.

MONT FALLU VISIBILITY IMPROVEMENTS

 

 

Purpose of the Report

 

To approve visibility improvements at the junction of Mont Fallu with Route de Beaumont and to install a bus shelter to serve stop No 3828 which is to the north of the junction. This scheme is in line with the Government of Jersey Strategic Plan, Road Safety and Sustainable Transport Policy.

 

 

Background

 

Following discussions between the Parish of St Peter and the Transport section of GHE in 2016 and 2017, the owner of Uplands Farm agreed to cede a section of land to the Public in order to improve the visibility of exiting from Mont Fallu onto Route de Beaumont and to construct a bus shelter on the town bound bus stop adjacent to the property.

 

 

Discussion

 

In 2017 the owner of Uplands Farm and their Architects met with the Parish of St Peter and the Transport section to discuss the potential for the conversion of a barn on the site. The existing access onto La Route de Beaumont was classed as being sub-standard for a 40mph road with visibility being less than 12m; the required visibility should be 74m. In order to improve the access, they proposed constructing a wide access adjacent to the existing one and re-aligning the entire length of wall between Mont Fallu junction and the new access which would leave footway space for a bus shelter and improve visibility when exiting from Mont Fallu. This proposal was acceptable to the Department but not to Planning due to the heritage impact.

 

Adjustments were made to the plans which improved visibility when leaving the site and from Mont Fallu junction. This involved setting back approximately 20m of the existing granite wall along the south-eastern boundary wall with Route de Beaumont by the junction of Mont Fallu. A bus shelter would be set back into the wall by the bus stop and the footway widened along the 20m length.

 

It was agreed between the owner and the then Director of Infrastructure that the additional land required for the improvements would be ceded to the Public free of charge. Work on the wall re-alignment and bus shelter would be carried out by GHE – Transport at their expense; all other works would be carried out by the owner.

 

Planning permission has been granted for the works, subject to signing of a Planning Obligation Agreement.

 

 

Conclusion

 

The proposed works will produce a betterment for the general public by increasing the visibility splays for vehicles exiting Mont Fallu, helping to improve road safety, increasing the footway width and providing a bus shelter for passengers waiting for the town bound bus.

 

 

 

 

Recommendation

 

The Minister is recommended to approve the proposals.
