Community Provisions (Control of Dual Use Items and Technology) (Application) (Jersey) Regulations 2002 - amendment.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the instruction to the Law Draftsman to prepare an Order to amend the Community Provisions (Control of Dual-Use Items and Technology) (Application) (Jersey) Regulations 2002 to take account of amendments made to Council Regulation (EC) Number 1334/2000.

Reason(s) for Decision: An amendment to the Community Provisions (Control of Dual-Use Items and Technology) (Application) (Jersey) Regulations 2002, (the Regulations), will keep the Island in line with European Community and UK regimes for controlling the export of dual-use items.

CUSTOMS AND IMMIGRATION SERVICE

Introduction  

This paper recommends an amendment to the Community Provisions (Control of Dual-Use Items and Technology) (Application) (Jersey) Regulations 2002.  The amendment will keep the Island in line with European Community and UK regimes for controlling the export of dual-use items. 

Background  

The Minister will recall that dual-use items are items, including software and technology, which can be used for both civil and military purposes. In 2000 the EC introduced a regime for the control of dual-use items by the introduction of Council Regulation (EC) No. 1334/2000.   

On 12th June 2002 the Community Provisions (Control of Dual-Use Items and Technology) (Application) (Jersey) Regulations 2002 were promulgated and extended Council Regulation (EC) 1334/2000 to the Island under the European Communities Legislation (Implementation) (Jersey) Law 1996.  (At the same time enabling Regulations were promulgated to implement the EC Regulation – the Community Provisions Dual-Use Items (Export Control) (Jersey) Regulations 2002.) 

Article 2(1) of the Community Provisions (Control of Dual-Use Items and Technology) (Application) (Jersey) Regulations 2002 states that “These Regulations may be amended by the Minister for Home Affairs by Order to take account of amendments made to Council Regulation (EC) Number 1334/2000.”  The amendments are actually made by including them in a table of amendments in Article 1(2) of that Order. 

Council Regulation (EC) Number 1167/2008, which will come into force on 2 January 2009, amends Council Regulation (EC) Number 1334/2000 by replacing all 200 plus pages of its Annexes which detail the dual-use items.   

The amending Regulation takes into account changes adopted by the Wassenaar Arrangement, the Australia Group and the Missile Technology Control Regime subsequent to the amendments made by Council Regulation (EC) Number 1183/2007.  

Recommendation  

The Minister is recommended to direct the Customs and Immigration Service to instruct the Law Draftsman to draft an Order to include the following reference in the table in Article 1(2) to the Community Provisions (Control of Dual-Use Items and Technology) (Application) (Jersey) Order 2002:-
