Financial Services Ombudsman (Jersey) Law 2014 (Appointed Day) (No.3) Act 201-: Lodging

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision:

The Financial Services Ombudsman (Jersey) Law 2014 was adopted by the States on 1st April 2014, sanctioned by Order of Her Majesty in Council on 16th July 2014 and registered by the Royal Court on 25th July 2014.

 

This Appointed Day Act would bring into force on 16th November 2015 the remaining provisions of the Financial Services Ombudsman (Jersey) Law 2014. Articles 7, 8, and 10 to 19 of the Financial Services Ombudsman (Jersey) Law 2014 will allow complaints to be referred to the OFSO.

Resource Implications:

There are no financial or manpower implications for the States.

Action required:

Assistant Director to request the Greffier of the States to arrange to lodge the Draft Appointed Day Act ‘au Greffe’, with a request that it be presented as soon as practicable.

There are no financial or manpower implications for the States arising from the

adoption of this draft Act.

 

Explanatory Note

This Act would bring the remaining provisions of the Financial Services Ombudsman (Jersey) Law 2014 into force on 16th November 2015, at which point complaints can be referred to the OFSO. Those provisions are Articles 7, 8, 10 and 11 (which form the remainder of Part 3), all of Part 4 (composed of Articles 12 to 18) and Article 19 (the only remaining provision in Part 5).

THE STATES, in pursuance of Article 27 of the Financial Services Ombudsman (Jersey) Law 2014, have made the following Act 

1 Commencement of remaining provisions

Articles 7, 8 and 10 to 19 of the Financial Services Ombudsman (Jersey) Law 2014 come into force on 16th November 2015.

2 Citation

This Act may be cited as the Financial Services Ombudsman (Jersey) Law 2014 (Appointed Day) (No. 3) Act 201-.
