A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the Mental Health (Jersey) Law 2016 Introductory Training Programme as required under Article 2 of the Mental Health (Miscellaneous Provisions and Prescribed Forms) (Jersey) Order 2018.

 

Reason(s) for Decision: The Department is commissioning the required training from an external professional legal training provider. This will facilitate intensive independent CPD-accredited training (including at short notice if required) to fulfil statutory requirements.

 

 

Resource Implications: Funding is from existing departmental resources.

REPORT

 

Article 2 of the Mental Health (Miscellaneous Provisions and Prescribed Forms) (Jersey) Order 2018 sets out the training and experience requirements for officers who the Minister may authorize under Article 6(1) of the Law as an Authorized Officer. Such training programmes have to be approved by the Minister.  

 

The training programme titled ‘Mental Health (Jersey) Law 2016 Introductory Training Programme’ is to be provided to those officers who are already trained as Approved Mental Health Professional within the meaning given by the Mental Health Act 1983 of the United Kingdom or Mental Health Officer within the meaning given by the Mental Health (Scotland) Act 2015 of the Scottish Parliament.

 

The training programme will be provided by an external professional legal training provider. It will deliver intensive independent CPD-accredited training (at short notice if necessary) to fulfil the statutory requirements.


Details of the one-day training programme for Authorized Officers is set out in Appendix 1.

By the end of the session, delegates will:

-          Recognise all the Parts and Schedules of the Law.

-          Understand the role of the Authorized Officer in implementing detentions.

-          Be aware of their role in protecting patients’ rights and autonomy.

-          Be familiar with the expectations of their role at Mental Health Review Tribunals or other Court Hearings.

-          Understand the powers of the Court within the Law.

-          Be familiar with how case law influences practice and review the outcomes of two cases with regard to their duty to consult nearest relative/person and making best interest decisions for physical health treatment of detained patients.
