Jersey Teachers' Superannuation Fund (JTSF): Appointments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

Following consideration by the States Employment Board (SEB) for the Chief Minister to agree to:

  1. appoint Michael De La Haye OBE on recommendation of Education Minister;
  2. re-appoint the nominees (as detailed in the attached report) to the Jersey Teachers’ Superannuation Fund Management Board for a further term of 3 years.

Reason(s) for Decision:

Under the Teachers’ Superannuation (Administration) (Jersey) Order 2007 Article 3 – Appointment of members of Management Board, the Chief Minister shall appoint to be members of the Management Board:

 

6 Employer representatives of whom –

  • 2 shall be persons recommended by the Minister for Treasury and Exchequer;
  • 2 shall be persons recommended by the Minister for Education;
  • 2 shall be any persons that the Chief Minister thinks fit; and

 

6 Member representatives, who shall have been selected in the manner that the Chief Minister shall agree with the associations that appear to the Minister for Education to represent the interests of teachers.

 

Members of the Management Board shall hold office for 3 years and shall be eligible for re-appointment. The Chief Minister may at any time remove from office any member of the Management Board appointed by him or her under this Article.

 

Due to the decision of an employer representative to resign their position on the Management Board, there was a requirement to appoint 1 new member. Following a fair and transparent selection process in line with the appointment commission guidelines a new member was chosen for appointment to the Management Board.

The current 3 year term for the remaining members of the Management Board is set to end on 31 December 2021 and they are eligible for reappointment to the board by the Chief Minister.

 

The recommendation to appoint/reappoint went to the SEB before being put before the Chief Minister for agreement. In 2022, a recruitment plan will be progressed to encourage diversity in applications for new members to the JTSF Management Board.

CHIEF MINISTER DECISION REPORT    

 

NOMINATIONS TO THE JERSEY TEACHERS SUPERANNUATION FUND (JTSF) MANAGEMENT BOARD

 

 

  1. Purpose of the Report

 

1.1.      To provide an update on the membership of the Jersey Teachers’ Superannuation Fund (JTSF) Management Board and the recommended appointments/reappointments for the next term of office.

 

1.2.      To outline the recruitment plan for 2022 to encourage a diverse range of applications for the honorary roles on the JTSF Management Board.

 

  1. Background

 

2.1. Under the Teachers’ Superannuation (Administration) (Jersey) Order 2007 Article 3 – Appointment of members of Management Board, the Chief Minister shall appoint to be members of the Management Board:

 

2.2. 6 Employer representatives of whom –

 

  • 2 shall be persons recommended by the Minister for Treasury and Resources;
  • 2 shall be persons recommended by the Minister for Education;
  • 2 shall be any persons that the Chief Minister thinks fit; and

 

2.3. 6 Member representatives, who shall have been selected in the manner that the Chief Minister shall agree with the associations that appear to the Minister for Education to represent the interests of teachers.

 

2.4. Under Article 3(2) of the Teachers’ Superannuation (Administration) (Jersey) Order 2007, members of the Management Board shall hold office for 3 years and shall be eligible for re-appointment. Article 3(4) of the same Order allows the Chief Minister to remove from office any member of the Management Board, at any time, appointed by him or her.

 

2.5. The employer and employee representatives are honorary roles and we are reliant on the goodwill of those willing to volunteer to undertake these governance roles. The 3 year term of office for the representatives cease at the end of December 2021. One of the current members of the Board, Mr Terry Le Sueur, has expressed a desire to stand down. A recruitment exercise has been undertaken to appoint new members.

 

  1. Recruitment Process

 

3.1. A recruitment process has recently been undertaken for employer representatives for the Management Board.  The honorary position was advertised through local media and on the Government of Jersey website.  Following the close date for applications, it was identified that only 1 person had applied. 

3.2. The applicant went through the full interview and selection process in line with the Jersey Appointments Commission Guidelines. A transparent process was followed including an interview with a diverse panel involving Graham Chidlow, Director of Finance Hub, Simon Stammers, Manager Pensions Administration and Janine Ward, Scheme Secretary.

 

3.3. The recommendation of recruitment panel was to put the applicant, Mr Michael De La Haye, forward for nomination to the position on the Management Board. The Minister for Education has signed a Ministerial Decision recommending to the Chief Minister the appointment of Michael De La Haye to the Management Board.

 

  1. Reappointment

 

4.1. Under Article 3(2) of the Teachers’ Superannuation (Administration) (Jersey) Order 2007, members of the Management Board are eligible for re-appointment.              The existing members of expressed a willingness to continue in their honorary roles and it is recommended that they are reappointed to maintain continuity pending a further recruitment campaign in 2022.

 

4.2. Ministerial Decisions have been signed by the Minister for Treasury and Resources and Minister for Education confirming their nominations for appointment of the employer representatives to the Management Board.

 

4.3. The employer representatives have all previously been selected through a formal recruitment process under the Appointment Commission Guidelines and are eligible for re-appointment. Employee nominees have been nominated by the associations that represent the interests of teachers and are also eligible for re-appointment.

4.5. Whilst nominations are appointed for a 3 year term under  Article 3(2) of the Teachers’ Superannuation (Administration) (Jersey) Order 2007, members it is expected that some members will retire in the near future and in 2022 a recruitment campaign will be progressed for new members.

 

 

  1. Recruitment Plan

 

5.1. In 2022, work will be undertaken with the People Services Resourcing Team to specify what is needed for the honorary roles and to encourage a diverse range of applications. Promotional activity will be undertaken to increase visibility of the roles and make them accessible to a wide range of applicants. In the first half of 2022, a recruitment campaign will begin for the new members to the JTSF Management Board to enable a period of handover ahead of expected forthcoming retirements. The States Employment Board will be kept informed of progress of the recruitment process.

 

  1. Recommendation

 

6.1. The Chief Minister is asked to;-

 

  • following the recommendation of the Minister for Education appoint Mr Michael De La Haye to the JTSF Management Board;

 

  • following the recommendations of the Minister for Education and Minister for Treasury & Resources reappoint nominations (Appendix A) to the JTSF Management Board;

 

  • note that in 2022 work will be undertaken with the People Services Resourcing Team to encourage diversity in applications for the recruitment to the honorary roles and appoint new members ahead of expected forthcoming retirements.  

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

APPENDIX A

 

 

EMPLOYER NOMINEE – MR MICHAEL DE LA HAYE OBE

 

 

Michael de la Haye was educated in Jersey and at the University of Nottingham and worked in Tunisia and France before returning to Jersey in 1986 to work at the Immigration and Nationality Department. He moved to the Law Officers' Department in 1994 as Chief Clerk and then transferred to the States Greffe in 1999. He was appointed as Deputy Greffier of the States in 2000 and Greffier of the States in 2002, a post he held for 13 years until December 2015.

 

After leaving office as Greffier he was a Commissioner of the Jersey Financial Services Commission for 3 years.

 

From 2019 to 2021 Mr de la Haye chaired the Housing Policy Development Board established by the Chief Minister and he is currently a member of the Strategic Housing Partnership and a member of the Steering Group for the Housing and Homelessness Project.

 

He is a Lay member of the Employment and Discrimination Tribunal and a Trustee of the Les Vaux Housing Trust. In 2020 he was appointed as a member of the Independent Panel overseeing the work of the Citizens' Jury on Assisted Dying. Since January 2019 he has been a Pensioner Representative on the Committee of Management of the Public Employees Pension Fund and he chairs the Audit sub-committee. Mr de la Haye is an Associate of the Chartered Governance Institute and he was awarded an OBE in June 2014 for services to the States Assembly and the Commonwealth Parliamentary Association.

 

EMPLOYER NOMINEE – MR JOHN EVERETT

 

Mr John Everett has held the position of Group Chief Risk Officer for the Equiom Group for two years. Prior to this he was the Deputy Director General of the Jersey Financial Services Commission and also worked on Jersey’s AML/CFT National Risk Assessment as the government’s Director of Financial Crime Strategy.

 

Before moving to Jersey, Mr Everett worked at the Financial Services Authority/Financial Conduct Authority in the UK where he focused on investment management and conduct issues, including representing the United Kingdom at European Union and international committees, and negotiating EU directives and regulations for the UK together with HM Treasury.

 

Mr Everett is an experienced public policy professional with leadership experience of both small and large teams. In the UK he was a Director of the Electoral Reform Society for a number of years and has also served as an ‘independent’ member of the Jersey Employment Forum.

 

 

 

 

 

 

EMPLOYER NOMINEE – MR JOHN MILLS, C.B.E.

 

After studying Medieval History at The Queen’s College, Oxford, and undertaking a research degree at Merton College, Mr Mills had an extensive public sector career from the 1970s until a decade ago: in London, Hong Kong, as chief executive of a large English local authority, and in Jersey, where for four years he was chief executive of the former Policy & Resources Department and the Island’s senior civil servant. His senior roles in London included several years as a member of the Prime Minister’s Policy Unit and as a director at DEFRA.

 

Since 2007 he has held a range of non-executive roles in the statutory sector in Jersey, including as a board member of the Jersey Financial Services Commission and as Deputy Chairman and senior independent director at Ports of Jersey Ltd. Since 2014 he has been the Jersey-based director on the board of the Channel Islands Financial Ombudsman. In 2017 he was appointed as the country’s first Charity Commissioner.

 

He has been an employer representative on the PEPF Committee of Management since 2009, chairing the Investment sub-Committee since 2013, and on the Teachers’ Superannuation Scheme Management Board since 2011.

 

EMPLOYER NOMINEE – JOHN LEONARD

 

Mr Leonard is partner at SaSo Strategic Advisers and is responsible for their Private Clients based in Jersey. He joined SaSo Strategic Advisers in August 2017 having spent the previous 7 years in an established financial services business where he was responsible for providing advice to both private and corporate clients in all areas of financial planning.

 

Mr Leonard specialises in pensions and investments and over the last 20 years has travelled extensively throughout the Middle East, Africa and Europe visiting clients from his background as Private Banker with EFG Private Bank, Standard Chartered and SG Hambros Bank.

 

A Chartered MCSI achieving the certificate of Private Client Investment Advice and Management (PCIAM) from the CISI (Level 6), he has spent the last 17 years living in Jersey, is married and enjoys spending time with his 2 children and on occasions may be seen on a sports field enjoying his passions of golf, football and tennis.

 

EMPLOYER NOMINEE – MR JASON TURNER, MSc, ACMA, CGMA

 

Mr Turner is the Parish of St Helier’s Chief Executive Officer responsible for the strategic leadership, operational management and delivery of Parish services.

 

With significant experience in the UK, encompassing both public and private sectors, Mr Turner moved to Jersey in 2000 and prior to his current appointment held a number of senior public sector positions in the island in both the Health Department and Treasury.

 

A qualified accountant with an MSc. In Information Systems, he has extensive experience in financial management, information technology and digital transformation.

 

EMPLOYER NOMINEE – MR GERALD WHITE

 

Mr White has extensive experience in human resources and remuneration issues, including pension scheme management. He started his career as an O&M Analyst for British Telecom in London, before joining States Personnel in Jersey, where he worked from 1977 to 1984 as O&M Analyst, Job Evaluation Manager and finally Personnel Development Manager.

He joined Standard Chartered Bank locally in 1984 and spent some 20 years with them in both in Jersey and in London, undertaking a range of human resources roles, local, global and corporate.  He ended his career with Standard Chartered as Director, Human Resources and Training – Offshore Businesses, while also covering the role of Regional Head of Human Resources for the UK and Europe.

 

For the 12 years to 2017 Mr White worked as a consultant on human resources and remuneration matters for local consultancy Hassell Blampied Associates, focusing on remuneration surveys and advice, and sensitive investigatory work. 

 

Mr White was Chairman of the Jersey Branch of the British Institute of Management from 1987 to 1990, a Trustee and Secretary of the Standard Chartered Offshore Islands Pension Scheme, and an Executive Director of Standard Chartered Grindlays (Offshore) Ltd.  He currently chairs the States Members Remuneration Review Body.  He is a Fellow of the Chartered Institute of Personnel and Development.

 

EMPLOYEE NOMINEE – MR MARK BARDSLEY

 

Mr Mark Bardsley was born in Bolton and worked as Engineer from 1982 until 2003, he achieved a BEng (Hons) in mechanical and production engineering. He started out as a multiskilled Mechanical Engineer and completed his career as Trouble-Shooter/Project Manager for a filtration company in Portsmouth.

 

After a change in vocation, he started his PGCE teaching training in 2003 in Portsmouth and moved to Jersey with his wife Victoria in 2004. He has enjoyed teaching Science and Mathematics at Grainville, Le Quennevais and now currently teaches Mathematics at Highlands College. In his spare time he likes to play guitar and cook food.

 

EMPLOYEE NOMINEE – MR TIMOTHY BALSTON

 

Mr Balston returned to Jersey after teaching successfully in the London Borough of Waltham Forest for twelve years, securing a post at Le Rocquier School. He completed twenty six years’ service in 2015.

 

Throughout his career he has been a member of the National Union for Teachers. His past roles in the union have included being a school representative, the President and Secretary of the Jersey Association of Teachers (NUT). He is currently acting as Secretary of the National Educational Union, Jersey District and heavily engaged in current union affairs negotiating on behalf of school members.

 

At present he is also Secretary, Trustee and an active listener for the Jersey Branch of The Samaritans. Having put three children through university, he feels his prudent approach will be helpful as a member of the JTSF.

 

EMPLOYEE NOMINEE – MR CHRIS BEIRNE

 

Mr Beirne is a representative of the Jersey Association of Headteachers. He has been Headmaster of Beaulieu Convent School for the past 14 years He is currently one off our most experienced Headteachers having previously held senior positions at Jersey College for Girls and Victoria College before moving to Beaulieu.

 

He has represented the Jersey Association of Headteachers as a member of the pension management board since 2007 and continues to serve the association in being asked to represent them having gained significant experience over these years in this work.

 

Mr Beirne has also served on the States of Jersey Complaints panel since 2009 and has been one of its vice-chairmen since 2014.

 

EMPLOYEE NOMINEE – MR GARY BURTON

 

Mr Burton has recently retired from teaching Maths and Computer Science for the last thirty seven years.

 

He has been an active member of the National Union of Teachers (now merged with the former Association of Teachers and Lecturers to form the National Education Union) for more than twenty five years and is a former President of the Jersey Branch.

 

He has maintained an interest in teachers' pensions since his return to Jersey in 1985 and has been a Member of the JTSF Board since its inception in 2007. He has served on both the investment and audit sub committees and is currently one of the JTSF representatives on the Treasury Advisory Panel for the States of Jersey Common Investment Fund, where investments for the teachers' superannuation fund are now located.

 

In his spare time, Mr Burton is keen on cycling around the green lanes of Jersey as well as singing tenor in a local choir.

 

EMPLOYEE NOMINEE – MR ADRIAN DESMOND

 

Mr Desmond was born in Cork City Ireland and moved to Jersey in 1989.  He has worked in various educational areas e.g. Highlands College and London Southbank University.  He worked in hospitality and Electronics and Electrical background for approximately 10-years before moving to Highlands College where he has worked as a Technician and progressed to Lecturer status 2009 achieving full status in 2011.

 

Achieved First Class BSc (Hons) Construction Management 2015 through London Southbank University and recently completed 2396 Design and Verification of Electrical Installations in 2018.

 

 

EMPLOYEE NOMINEE – MR TERRY SHAW

 

Mr Shaw came to Jersey in 1987 as Head of Maths at Le Rocquier School before becoming a Senior Teacher and part of the Leadership team. 

 

He has been involved with the NASUWT on the island since 1987.  He became the local representative for a period of 6 years which involved case work, pay talks and areas surrounding conditions of service.

 

In 2003 he left Le Rocquier and moved to Beaulieu where he was responsible for assessment recording and reporting. 

 

Mr Shaw retired in 2012 but continued to work for 10 hours a week at Beaulieu across a number of areas.  He retired completely in 2014 and has been on the Management Board since its inception in 2007 as a NASUWT representative.
